1. Acceptance of Terms
By accessing or using TractSheet ("the Service"), operated by TractSheet ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
TractSheet is an automated document extraction tool designed for oil and gas title examination. The Service allows users to upload recorded instruments (deeds, leases, assignments, etc.) and receive structured data extraction including grantor/grantee names, legal descriptions, recording information, and clause analysis.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload documents you do not have the right to process
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Circumvent usage limits, rate limits, or access controls
- Resell or redistribute the Service without written permission
- Use automated scripts to access the Service beyond the provided API
5. Document Processing and Data
Your Documents: You retain all rights to documents you upload. We do not claim ownership of your content. Original uploaded files are processed in memory and are not permanently stored. Only extracted structured data is saved to your account.
Extraction Accuracy: The Service uses automated extraction to process documents. While we employ dual-pass verification and validation to maximize accuracy, extracted data may contain errors. You are responsible for reviewing and verifying all extracted data before relying on it for title opinions, legal decisions, or other professional purposes. The Service is a tool to assist title examination, not a substitute for professional judgment.
6. Payments and Credits
The Service offers document processing credits on a pay-per-use basis. Credits are purchased through Stripe and are non-refundable except as required by law. Free trial credits may be offered and are subject to one allocation per account. Pricing is subject to change with notice.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EXTRACTIONS WILL BE COMPLETELY ACCURATE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACTSHEET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless TractSheet and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period following account termination.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or in-app notification.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
